Regularization and rehabilitation of occupied buildings in urban centers

Resumo
It’s important to reposition the demands of popular housing movements in the processes of occupation of buildings in urban centers in the context of questioning non used proprieties and advancing the social function of property and the city, as well as affirming the right to adequate housing. These are important analytical lens to understand and face the situation in occupied buildings that are gradually becoming effective housing option for the low-income population. In order to ensure safe housing conditions in these occupations that constitute original ways of living it is necessary to re-inscribe the issue from the perspective of territorial conflicts and problematize risk management with a view to qualifying security and reducing vulnerability, in line with the agenda of land regularization. Considering the context of land conflicts and using the theoretical framework of land regularization, this article problematizes the absence of public policy for the occupation of vacant buildings in central areas. Based on qualitative analysis of data on occupations, intervention reports on them and bibliographical review it scrutinizes the design of a legal path that allows the permanence with fulfillment of housing rights in occupations, without neglecting the improvement of urban and environmental conditions, central aspects in land regularization. In doing so the article highlights the importance and legal possibility of regularizing buildings informally occupied.
