Resumo

The regulation of work mediated by digital platforms has become one of the central contemporary challenges for public policy in Brazil, gaining prominence in public debate particularly after the COVID-19 pandemic. In this context, the federal government’s creation, in 2023, of a Tripartite Interministerial Working Group (task group or “GT”) represented an unprecedented initiative to build a regulatory proposal through a consensual process. However, the process culminated in the presentation of Complementary Bill (PLP) 12/24, a proposal that failed to achieve consensus and was rejected by a significant share of platform workers. This dissertation addressed the following research question: how did relations between civil society and the government unfold in the construction of PLP 12/24 within the context of the interministerial working group? Aimed at analyzing the dynamics of participation, contestation, and power asymmetries that permeated this deliberative arena, the study was conducted as a qualitative case study with an interpretive orientation, based on documentary analysis of the groups’s official minutes (obtained through the Brazilian Access to Information Law – “LAI”) and triangulated with academic publications and public statements by the actors involved. The analysis was theoretically grounded in the concept of civil society as a field of strategic action, examining disputes through the notions of progressive and regressive infiltration. The findings indicate that, although the group opened a space for negotiation, it was marked by a profound asymmetry in preparation and power among the delegations, as well as by an institutional design that, by privileging representation through trade union confederations, excluded grassroots voices and organizations within the category. The group’s failure to produce a legitimate agreement catalyzed a shift of contention to the legislative arena and to the streets, with particular emphasis on the greater mobilization capacity of delivery workers compared to drivers. The study concludes that the deliberative arrangement proved to be more symbolic than effective, resulting in a regulatory proposal with weak social anchoring and exposing the complex challenges of political representation and public policy-making in the face of the reconfiguration of work.
