Regulação do setor mineráriouma abordagem histórica e análise dos aspectos jurídicos e econômicos a serem considerados em uma proposta de reforma

Resumo

The elaboration of a reform agenda for the mining sector demands a multisectorial comprehension of past regulatory experiences. Such an approach can provide appropriate understanding on how regulatory alternatives are shaped by several dimensions such as the motivations that enabled the creation of a regulatory rule, the institutional scenario that was designed to deal with the existing challenges and, above all, the economic context. This work accepts the complex task of mapping all the different areas of knowledge that must be considered in any appropriate debate about sectorial regulation and presents the conflicting interests in stake. We have also assumed the ambitious goal of analyzing three different regulatory regimes for the mining sector. Even though these three regimes are not the only options available we have chosen it due to its thematic relevance in dealing with market failures as well as reconciling different interests in stake.
