Proposta de aprimoramento do regime jurídico das imunidades parlamentares no Brasil

Resumo

The research is aimed at formulating a policy to improve the legal framework of parliamentary immunities in Brazil. For this purpose, initially, it discusses the theoretical foundations and functions of the institute, the problems and risks related to its existence, and the importance of rethinking it in Brazil. Then, it details how it has been regulated by the 1988 Federal Constitution and analyses how the Brazilian Supreme Court has applied these rules throughout the last twenty years. In the end, it identifies the main problems in its application and in which ways the law could be changed to address such issues.
