Resumo

International Agreements can be seen as one of the main reasons for the increasing strength of the practice of international commerce. The present paper focuses on analyzing how the legal language regarding flexibilities on regional commerce agreements developed throughout time from a context of multilateral commerce to, more recently, a bilateral one. This paper consists of two parts: (i) a historical and conceptual contextualization of the Special and Differential Treatment and the language of flexibilities; and (ii) the mapping and systematizing of said language in two regional treaties, namely the Transpacific Partnership (TPP) and the 'Acordo de Ampliação Econômico-Comercial entre a República Federativa do Brasil e a República do Peru' (Brazil-Peru Agreement). The analysis of said treaties will assist in the identification of a possible pattern in flexibility clauses, or even help to identify the lack of any patterns whatsoever, keeping in mind that each agreement has its own language. This specific analysis will focus on the Chapter of Government Procurement. The choice for this specific chapter was made in face of the importance of the subject for developing countries, as well as due to the fact that the dispositions on governmental purchases carry with them innovations regarding the language of exceptions. Lastly, after said systematizing, it will be inquired whether a pattern on flexibility clauses exists and, if so, how said pattern can influence the performance of developing countries in the context international commerce. and analyze how this pattern was established in the language and writing of the agreements.
