Resumo

This paper aims to understand whether the legal treatment of the freeze of the defendants’ assets in lawsuits for administrative improbity, as firmed by the Superior Court of Justice in its statement n. 701, finds support in the legal and constitutional system of provisional protection, taking into account its theoretical aspects and practical results. The article 7 Law 8,429/1992 provision, which highlighted the applicability of the relief in such actions, was interpreted by the Superior Court of Justice as distinct from the general system of provisional protection. For this reason, nowadays the courts all over the country apply the binding precedent by which the periculum in mora (danger in delay) condition is implicit or presumed in the referred actions, so that its demonstration is dispensable in such cases. An analysis of the Superior Court of Justice’s historical evolution over the matter will be done followed by a research about the civil procedure theory and especially about the freeze of assets in administrative improbity lawsuits. By the end, a jurisprudential survey by sampling will be exposed among the administrative improbity lawsuits filed in Rio de Janeiro’s State Court from 2015 to 2019 in order to evaluate the application of the binding rule of the STJ in the specific cases of the State.
