O império da subjetividadeo reconhecimento da parentalidade socioafetiva à luz do neoconstitucionalismo e da ética da autenticidade de Charles Taylor

Resumo

This paper aims to analyze the arguments of Justice Luiz Fux in the Extraordinary Appeal (Recurso Extraordinário) n. 898.060/SC (recognition, by the Brazilian Supreme Court, of legal parenthood based solely on affection, as from the right to the pursuit of happiness and the principle of human dignity). Such analysis will be guided by theoretical propositions on modern subjectivity (especially Charles Taylor’s concepts of ethics of authenticity and social imaginaries) and neo-constitutionalism. The approach is thus fundamentally descriptive. Bibliographic revision was the adopted methodology so that the concepts were used as analytical tools for the legal arguments of the specific case. The main hypothesis here is that there is a mutual influence between forms of subjectivity and forms of political and legal organization, and that, today, there is a mismatch between those instances which causes a conflict between normative symbolic structures and desire of individual expression. It is also presupposed that the modern legal-philosophical concept of individual somehow echoes in the Law, especially regarding fundamental rights and human dignity. In this sense, the research concludes that Fux’s vote in the Extraordinary Appeal (Recurso Extraordinário) n. 898.060/SC reveals aspects of modern subjectivity (instrumental rationality, valorization of autonomy, and the pursuit of happiness) as well as of the paradigm of neo-constitutionalism (Judiciary’s protagonism, principled hermeneutics, and primacy of fundamental rights). It also claims that there is a conflict between new forms of subjectivity of the post-Modernity, founded on the refusal of a metaphysical universalist concept of human dignity, and the modern representation of the Law.
