Resumo
The high number of suspended public infrastructure contracts in Brazil, especially those financed with federal funds, reveals weaknesses in planning, execution, and contract management, with impacts on costs, deadlines, continuity of works, implementation of public policies, and litigation. In this context, the dissertation examines the incorporation of Dispute Prevention and Resolution Committees (dispute boards) as a mechanism for the timely handling of disputes during the execution phase and investigates the following research problem: how have oversight bodies admitted, assessed, and interpreted the decisions of these committees in public infrastructure contracts, in light of judicial decisions and external control rulings? The hypothesis maintains that, despite the still limited number of pronouncements, no consistent trend of revising or annulling the statements issued by the committees can be identified. The general objective is to analyze the use of dispute boards in public infrastructure contracts in Brazil, considering the applicable legal framework and the treatment given to their decisions by oversight bodies. As specific objectives, the study examines the origin, legal nature, modalities, and procedure of the institute, its contractual incorporation, and its limits and potential within the Brazilian legal-administrative environment. A qualitative, descriptive-analytical methodology is adopted, with bibliographic and documentary research, combined with a case study. The empirical selection began with 54 decisions identified through a legal search tool (Jusbrasil), which were subjected to thematic filters until 12 core decisions were defined for analysis. The results indicate that the institute is not rejected in the abstract; controversies focus on structural requirements, such as normative basis, competence, and procedure. In the cases examined, the technical statements were upheld, corroborating the hypothesis and pointing to the mechanism’s potential for consolidation.
