Resumo

This work analyses the comic book Blue is the warmest color and the Federal Supreme Court’s decision regarding the censorship of a gay kiss displayed on a comic book being sold during Rio de Janeiro’s book Bienal on 2019, seeking to understand the dinamics between protagonism and antagonism (respectively, players who struggle for LGBTQIA+ community’s right to fully live and players who hinder this right’s fullfilment), dinamics existing on the comics as well as on the decision. The purpose aimed in this work is to understand the connection between social perception and legal rulings about sexuality’s full living, which is related to the rights of identity freedom and sexual self-determination. Both rights depend on social and legal acknowledgment to be accomplished, and these affirmations happen to be in a constant conflict. The main theoretical guidelines are François Ost (2007) for the relationship between literary works and law; and Charles Taylor (1994 and 2004) for the identity development and the value of recognition into this process.
