O Controle judicial dos acordos de colaboração premiada da Lei 12.850/2013

Resumo

The following monograph analyzes how the Supreme Court and the Superior Court of Justice judicially control the terms of a rewarded collaboration agreement, which is legally regulated by the Federal Law n. 12.850/2013 (which defines Organized Crime, among other rules). The chapters are divided in (1) Introduction, (2) Foundations of the Rewarded Collaboration, (3) Judicial Control of the Terms of a Rewarded Collaboration, (4) Conclusion. This analysis is essentially qualitative, and it was made through an extensive research of the precedents of such courts. In the end, it is possible to conclude that these courts do not effectively limit the clauses of a rewarded collaboration agreement, ratifying a series of terms which concede extralegal benefits and rights to collaborators. The courts also prevent, through their rulings, any kind of questioning regarding the agreements by defendants pointed out as criminals by such collaborators.
