O Conselho Nacional de Justiça e a formulação de políticas públicas judiciáriasuma análise das iniciativas voltadas à equidade racial

Resumo

The incorporation of racial equity as an institutional agenda within the Brazilian Judiciary is a recent phenomenon that remains underexplored in academic literature. Although the National Council of Justice (CNJ) has produced a significant set of judicial public policies aimed at addressing institutional racism, important gaps persist regarding the analysis of these initiatives, their normative designs, implementation mechanisms, and monitoring strategies. In this context, this research sought to examine how the National Council of Justice, from its creation in 2005 to 2025, has formulated judicial public policies aimed at racial equity, as well as to identify the institutional mechanisms that condition their implementation and monitoring. The methodological approach combined documentary analysis of normative acts issued by the CNJ with a literature review. The findings indicate that the racial equity agenda within the CNJ is structured across multiple fronts, including affirmative action and representativeness, guarantees of access to justice, incorporation of intersectional perspectives in judicial decision-making, institutional recognition, and the production of data and participatory forums. A progressive increase in normative production over time is observed, with a marked intensification from 2020 onwards, suggesting a gradual process of institutionalization of this agenda. At the same time, the study identifies significant weaknesses in the mechanisms for monitoring and evaluating these policies, as well as limitations stemming from their decentralized implementation across courts. As a scholarly contribution, the study provides a systematic mapping of judicial public policies on racial equity within the CNJ, articulating this analysis with the theoretical framework of public policy studies. By moving beyond an exclusive focus on racial quotas toward a broader examination of policy formulation, implementation, and monitoring, the research expands the understanding of the Judiciary’s role as a governance actor and of the challenges involved in institutionalizing racial justice agendas. It thus contributes to debates on institutional capacity, judicial governance, and the democratization of the Brazilian justice system.
