Resumo

The purpose of this paper is to analyze the impact of the intellectual property abuse in the competition and CADE’s practice in its deterrence. For such a purpose, extensive bibliographic revision was conducted, in order to explore the most essential concepts and relevant intersections in these two fields of the Law. Subsequently, a case study was conducted on CADE’s precedent involving the administrative decision against the global pharmaceutical company Eli Lilly due to intellectual property abuse related to sham litigation, which is established within the sensible context of the pharmaceutical patents in Brazil. It can be concluded from the precedent that CADE is assured of its incisive activity in cases involving intellectual property abuse causing harm to competition, especially when implemented via sham litigation. In order to refrain such abuse, the antitrust authority puts significant effort into the interpretation and application of intellectual property laws, including technical and procedure laws. Notwithstanding, it lacks in acknowledgement and detailing of the harm that is capable of triggering antitrust protection.
