Resumo
The carbon market establishes a new type of property – the carbon credit, which encompasses a new set of rights and obligations. In this sense, a comprehensive understanding of the carbon credits legal nature is essential to delineate which rights and obligations are applicable to this institute. The prevailing legislative perspectives on this issue vary considerably, impacting the regulatory framework of carbon credits and, consequently, hindering the development of the carbon market in Brazil. This study aims to investigate these perspectives, their effects, and to provide a foundation for constructing an appropriate legal framework for the institute.
