Resumo

The present work intends to investigate the impact of the precedent of the Federal Supreme Court, the collective habeas corpus nº 143.41, judged in 2018, in the performance of the judges of the Court of Justice of the State of São Paulo, through the production of a database of decisions issued in the seven months preceding and succeeding the granting of the habeas by the Supreme Court. The precedent refers to the granting of the benefit of house arrest, replacing the pre-trial preventive custody, contained in article 318 of the Brazilian Code of Criminal Procedure. The cross-referencing of the data in the research tries to reveal the pattern of responses of the judges to the demands of mothers and pregnant women in preventive custody in Brazil
