Licenciamento ambiental municipal e sua relação com a Política Nacional do Meio Ambienteum estudo em municípios goianos

Resumo

Objective – Understand the challenges encountered by the Municipalities of Goiás when exercising environmental licensing and its relationship with the National Environmental Policy (PNMA). To this end, an empirical study was conducted in municipalities in Goiás with different realities in licensing activities. Methodology – Of an empirical nature, secondary data was used (collection and analysis of information contained on the website of the state environmental agency), and primary data (semi-structured questionnaire sent to those responsible for the municipal environmental departments of fifteen municipalities in Goiás), aimed at understanding the factors that influence the exercise of municipal competence for environmental licensing in the State of Goiás. Results – The results demonstrate that there is a major deficiency in the cooperation regime between federated entities enshrined in the Federal Constitution and the National Environmental Policy (PNMA), as well as the existence of a weakness in environmental governance that encourages the effective exercise of licensing environment at the local level. Limitations – The study was faced with a scarce number of scientific articles that deal with municipal licensing and, in the questionnaire phase, only 60% (sixty percent) of the Municipalities consulted in Goiás responded to the questions asked, even though 4 (four) reiterations were carried out. Thus, to better support the research, secondary data was sought from the State Council for the Environment of Goiás (CEMAm) and the State Secretariat for the Environment and Sustainable Development of the State of Goiás (SEMAD) Applicability of the work – This work is a reference for thinking about perspectives for analyzing public policies relating to the environment and their implementation over the 42 (forty-two) years after the publication of Law No. 6,938, of August 31, 1981. Contributions to society – The analysis of public policies in academic works represents a contribution from academia to Public Administration, with the purpose of discussing whether a given policy is having the effects desired by the formulator and society. In the study under analysis, we seek to verify whether there is effectiveness in the implementation of the National Environmental Policy (PNMA) regarding the exercise of environmental licensing by the Municipalities of Goiás. Originality – The study in question presents a perspective that is rarely found in relation to the analysis of the reasons why the majority of Goiás municipalities do not exercise the legal competence to analyze environmental licensing and how this omission impacts the system of national policy aimed at protecting the environment. environment.
