Resumo

The study examines the discussions surrounding the principle of the supremacy of the public interest in Brazilian law, with emphasis on its application in the field of regulation. It seeks to build a balanced view between the strands that defend and those that question its contemporary relevance and applicability, proposing a reinterpretation compatible with the democraticconstitutional paradigm of the 1988 Constitution. Initially, the theoretical and normative foundations of the principle are analyzed, from its classical origins in Administrative Law to its reconstruction in light of fundamental rights. It is argued that, rather than discarding the principle, it is more appropriate to subject it to a process of balancing guided by objective parameters that ensure its rational, reasoned, and proportional application by public administrators. To this end, four criteria are proposed: observance of legal and constitutional limits, the duty of reasoning, the duty of proportionality, and the maximum compensation to the affected individual. Then, the conflicts between public and private interests in the legislation of federal regulatory agencies and in the case law of the Supreme Federal Court are examined, identifying how these criteria can be operationalized in practice, considering that, by nature, regulatory activities seek to harmonize and adjust private conduct to the achievement of collective objectives. The study thus aims to contribute to a more balanced and constitutionally oriented understanding of the principle within the current legal context.
