Fragmentação institucional e coordenação regulatória na proteção de crianças e adolescentes no ambiente digital

Resumo

The protection of children and adolescents in the digital environment took on new institutional contours with Law No. 15,211/2025 (Digital ECA), which introduced regulatory agents alongside the traditional actors of the Child and Adolescent Rights Guarantee System (SGDCA). The research problem is to understand how the institutional arrangement for coordination among these actors is configured and the extent to which it is adequate for coordinated action accessible to those affected. The theoretical framework combines polycentric regulation theory, the taxonomy of coordination in shared regulatory spaces, the analysis of duplicate delegations, and the design of inter-agency interaction mechanisms, in dialogue with the Brazilian literature on regulatory coordination, particularly the experiences of competition policy and the national financial system. The method is qualitative, exploratory, and descriptive, with documentary analysis as the main technique: four analytical instruments were applied to a corpus of normative, deliberative, technical-informative, and comparative documents, following framework analysis procedures. The analysis maps state and non-state actors, identifies overlapping competences, attribution gaps, and the absence of formal articulation protocols, revealing a model that oscillates between precarious cooperation and unstructured competition, with ambiguity costs for regulated entities and inaccessibility for affected individuals, who do not know whom to turn to. The coordination instruments dedicated to this area prove structurally inadequate to the high interdependence of the problem, which would require interfaces based on binding rules. As a contribution, the research maps the digital regulatory space for child and adolescent protection in Brazil, adopts the perspective of those affected as an evaluation criterion, and proposes institutional redesign recommendations, such as the designation of a lead agency, formal interagency cooperation protocols, and clarification of competences. The dissertation is part of the Economy, Intervention and Regulatory Strategies research line of the PPGD/FGV Direito Rio, in dialogue with the project Institutional Interactions and Regulatory Decision-Making.
