Fragilidades dos mecanismos de controle das organizações sociais de saúde no município do Rio de Janeiro

Resumo

The research problem of this study is the evaluation of the acting ofhealth social organizations’ main control mechanisms, in the specific case of the Municipality of Rio de Janeiro. The recurrent denouncement of irregularities and illegalities by the Court of Audit of the City of Rio de Janeiro and the Public Prosecutor’s Office of the State of Rio de Janeiro has raised doubt concerning the adequacy of the monitoring, control and oversight of these entities. This implies our main research objective that is to identify the weaknesses of the new public management model by health social organizations, in the case of the city of Rio de Janeiro. For this, were analyzed: the legal and normative framework of the local model, from a comparative analysis between the municipal law governing its operation (Law 5.026/09) and its federal counterpart (Law 9.637/98); health indicators measuring the social organizations’ performance; all Court Audit’s inspections made before the end of 2015; and the set of recommendations sent by the Public Prosecutor’s Office to the City Hall after the deflagration of the Operation Fiscal Island, which resulted in the disqualification of the Social Organization called BIOTECH and the prison of its leaders, accused of embezzling more than R$48 million in public resources. On final conclusions, it was found that the weaknesses of the municipal legislation and executive decrees regulating the activities of the Health Social Organizations in the Municipality of Rio de Janeiro do not enable the effective control of the partnership by the State, therefore going against the constitutional provision which determinates that Health Social Organization’s activities under the SUS are to be limited to a complementary position. Moreover, it was identified the complete inadequacy of the control structure by the City Hall, whose main consequence was to pervert the managerial perform intended into a model that encourages patrimonial behavior within the public health system, since control of measures was completely neglected.
