Resumo

This study was designed to explore the practical application of Article 155 of the Code of Criminal Procedure (CPP), focusing on the evidentiary sufficiency of police testimony. It examines the challenges involved in applying Article 155 of the CPP, as well as its wording introduced by the reform of Law 11,690/2008. Initially, the work was based on a bibliographic review of legal literature on judicial epistemology, criminal evidence, and the reform of Law 11,690/2008. To illustrate theoretical discussions, a case study was chosen, focusing on the full records of AREsp 2236994/SP in the Brazilian Superior Court of Justice (STJ). In addition to the main case study, a jurisprudential survey was conducted in the STJ to identify similar cases in which police testimony was used as the primary evidentiary element. Ultimately, the study concludes that a coherent application of the adversarial principle and the requirement for complementary evidence are essential to preserve defendants' rights, ensuring that criminal proceedings uphold the principles of due process and the presumption of innocence.
