Resumo

The Brazilian Code of Civil Procedure in effect provides for the possibility of modification of the procedure on the initiative of the parties and their lawyers, as set forth in Section 190. It is the so-called “Procedural Legal Transaction”. Regardless of the rule prescribed in said section, some Brazilian civil procedure jurists advocate the need for establishing non-casuistic limits, in order to define the parameters of the referred principle. This research aims precisely to contribute to the establishment of this non-casuistic limit. To that end, based on the knowledge taught by Judith Martins Costa and Karl Engisch, also guided by judicial decisions rendered by the five most significant State Apellate Courts of Brazil, this study has the purpose of developing the guidelines required to establish limits to the freedom of executing Procedural Legal Transactions.
