Resumo
The present work will seek to understand if there is legitimacy and legal validity of the stipulation of contractual clauses that deal with the production of evidence in a possible litigation as an atypical procedural agreement mechanism in the context of contracts for the purchase and sale of agricultural commodities, as well as explore the need and the practical benefits of such mechanism within the scope of such legal relationship. This is an exploratory work with a brief analysis of judicial precedents that already discussed procedural agreements in terms of evidence in order to evaluate the arguments brought and how the country's jurisprudence has positioned itself on the subject.
