Resumo

This study was devoted to demonstrating the usefulness of procedural agreements within the context of real estate transactions, presenting the instrument as a means of enhancing efficiency both in the execution of such transactions and in the resolution or mitigation of the disputes arising therefrom. The research analyzes the shift from a rigid to a flexible conception of procedure, in service of the realization of substantive rights, particularly through agreements between the parties — a possibility firmly established by the 2015 Brazilian Code of Civil Procedure. Starting from this premise, the study examines the procedural legal transaction and its main characteristics. Given the scope of the research, the work seeks to demonstrate that, within the realm of real estate transactions, the conventional modification of procedural rules and/or the legal positions of the parties involved constitutes a technique that: (i) contributes to the optimization of contractual dispute resolution; and (ii) may be incorporated into the contractual synallagma, composing the trade-off inherent to the underlying economic operation. These possible configurations of the procedural legal transaction reinforce both the need to uphold such agreements and the relevance of this research. Finally, drawing upon practical scenarios observed within the chosen field of study, the research proposes specific procedural agreements that may prove useful to the real estate sector.
