Resumo

This study examines the alignment between the implementation of Brazil’s basic sanitation public policy and the institutional objectives established by the Sanitation Legal Frameworks— Law No. 11,445/2007 and Law No. 14,026/2020 — using compliance with the 2023 intermediate targets of the National Basic Sanitation Plan (PLANSAB) as a reference, specifically in the water supply and sanitary sewerage components. These targets serve as the central benchmark for assessing institutional effectiveness, making it possible to evaluate whether the regulatory framework and planning instruments have generated tangible outcomes and progress toward the universalization goal projected for 2033 and, if not, to identify the factors that hinder this trajectory. The methodology integrates qualitative and quantitative approaches. On the qualitative side, a bibliographic and documentary review was conducted on the evolution of sanitation public policies since the early twentieth century, contextualizing the historical and institutional factors that explain the persistence of the sector’s structural deficit. This process includes a synthesis of the trajectory of the Legal Frameworks since 2007, which reorganized the regulatory model, planning instruments, and financing mechanisms. On the quantitative side, compliance with the 2023 intermediate targets was assessed through selected diagnostic indicators, using consolidated data from the National Sanitation Information System (SNIS) and the National Basic Sanitation Information System (SINISA), compared against the targets established in PLANSAB. The analysis is grounded in the premise that the effectiveness of this robust legal framework — designed to organize the sector and establish universalization targets — may be insufficient in the absence of institutional arrangements that enable its implementation, ensure the availability of financial resources required for investment, and provide oversight mechanisms capable of guaranteeing both their appropriate allocation and their materialization into infrastructure, in alignment with the defined targets. The study’s findings validate this hypothesis, revealing a high degree of distortions and noncompliance with coverage and investment targets, thereby jeopardizing the achievement of universalization by 2033. This evidence reinforces the need to establish and effectively implement such institutional arrangements and control mechanisms, with a view to safeguarding the execution of investments and their efficient allocation.
