Dispute adjudication boards e negócio jurídico processualo problema da revisão liminar

Resumo

This study analyzes the implications of early jurisdictional intervention, whether judicial or arbitral, in response to decisions made by Dispute Adjudication Boards (DABs) and proposes solutions to strengthen the decisions issued by this type of dispute prevention and resolution board. The study briefly addresses the DABs, their nature, and their effectiveness in resolving conflicts in major construction projects. Additionally, it examines elements of procedural legal transactions relevant to the proposed practical solution. The research also examines the São Paulo Metro case as a practical example of preliminary intervention in response to a decision made by a DAB. Finally, the work presents a suggestion for a contractual clause instituting a procedural legal transaction, as well as a legislative proposal for the regulation of the discussed topic.
