Resumo

The present work deals with Animal Law in the Brazilian legal context, from the analysis of the constitutional sphere, federal, state and municipal legislation, as well as the bills that change them, also from the jurisprudential and doctrinal scope, covering the philosophical and legal boundaries of the question. Thus, the aim is to understand the rationale for the qualification of the non-human animal as a subject of law, dealing with the possibility of granting procedural capacity to animals as a result of access to justice, guaranteed to the holders of rights. Therefore, cases in which the animal, as an individual, appears as a party in the action, configure tertiary judicialization, which is the way to make animal rights effective. Finally, the critical perspective that focuses on the analysis is in the sense of catching the anthropocentric movements, in which speciesism prevails, demonstrating the long path that Animal Law has ahead.
