Resumo
This work analyzes the current scenario of maturity and institutionalization of the Regulatory Impact Analysis (RIA) within the scope of federal environmental regulatory bodies, namely, the Ministry of Environment and Climate Change (MMA), the National Council for the Environment (Conana), the Brazilian Institute for the Environment and Renewable Natural Resources (Ibama), the Chico Mendes Institute for Biodiversity Conservation (ICMBio), the Brazilian Forest Service (SFB) and the National Agency for Water and Basic Sanitation (ANA). The justification stems from both the importance and the role currently assigned to RIA (representing one of the components of “best regulatory practices” and mandatory for all federal public administration), as well as the inherent characteristics of environmental regulation. To this end, it presents a discussion on the context of RIA and environmental regulation in Brazil, highlighting the reference literature and the different applicable legal frameworks. From a methodological point of view, an empirical approach is adopted, of a quali-quantitative nature, through the collection, treatment and analysis of data related to the performance of the RIA by the federal environmental agencies. From the analysis carried out, it was identified, with the exception of the ANA, the other federal environmental agencies are still far from the necessary level of institutionalization of the AIR within the scope of its attributions and competences. On the other hand, it is possible to point out ways and alternatives for the improvement of RIA procedures by federal environmental agencies.
