Conselhos tutelares e setor público no município de São Paulo

Resumo

The present work aims at comprehending the insertion of the Brazilian Guardianship Councils in the Child’s Rights Defense Framework (Sistema de Garantia de Direitos da Criança e do Adolescente – SGDCA) from the point of view of public sector actors. It is a qualitative exploratory research carried out in the municipality of São Paulo. There were two groups of semi-structured interviews. In the first group guardianship councilors were listened, in the second were listened some actors from the SGDCA linked to the public sector. The investigation acknowledged some constrains and limits to the guardianship councilors performance, as for example inappropriate infrastructures and lack of social equipments and entities to support council’s attribution of defending children’s rights. These constraints show that weak councils performance are not explained mainly due to councils constitution or councilors characters, as part of the literature on councils suggest. The work field brought some evidences that performance also depends on the relationship between guardianship councils and the other actors from the SGDCA. Accordingly to this research, the lack of transparency on budget resources addressed to guardianship councils in the municipality of São Paulo in addition to the absence of labor rights for the councilors weaken councils efficiency. In some circumstances these councils become subordinated to the other actors from the SGDCA. On the other hand, this study reinforced the concept that executive authority attributes low priority for theses councils appointed by the literature on guardianship councils. The best bet should be that an appropriate performance of the guardianship councils as well as the whole SGDCA still depends on recognizing children rights.
