Resumo
In 2023, the European Union published an initiative to regulate deforestation through trade-related measures: the European Union Deforestation-Free Products Regulation – Regulation (EU) 2023/1115 (EUDR). Although the regulation applies directly only to companies domiciled within the European Union (EU), it covers import trade flows of commodities destined for the European market, thereby affecting third countries such as Brazil. In this context, Brazilian producers involved in export-oriented production may be impacted, including through the potential prohibition of exporting relevant products to the European market. The effects of the regulation in countries outside the European Union present several challenges, including the need for clarification regarding legal definitions that differ from those in the country of origin of the product concerned. Given its relevance to Brazilian production systems, which are highly integrated into international agricultural and forestry commodity supply chains, this technical brief aims to guide Brazilian producers and exporters in complying with the regulation, thereby enabling continued access to the European market. Its content is based on technical and legal documents developed within the framework of the project “Monitoring the Regulatory Impact of the EUDR in Brazil,” funded by the Climate and Society Institute (iCS) and conducted by the Center for Research in Global Law (CPDG) and the Jean Monnet Centre of Excellence on EU-LA Global Challenges (2023–2026), co-funded by the European Union under the Erasmus+ programme, both affiliated with FGV Direito Rio.
