Resumo
Purpose: The main objective of the research was to analyze the need for updating the Public Policy in the broadcasting sector - the Brazilian Telecommunications Code (CBT) of 1962, based on interviews with industry experts. This analysis is relevant because it pertains to the legislation that dictates how the public administration operates in the broadcasting sector. Furthermore, in a rapidly evolving technological landscape, it is important to assess whether the model established by this 60-year-old legislation remains capable of addressing the current challenges in broadcasting.
 Methodology: The study adopted a qualitative approach. For this purpose, interviews were conducted with broadcasting experts from various sectors (Government, Private Sector, Academia, and Third Sector) regarding the ability of the CBT to regulate broadcasting. Additionally, a bibliographic and documentary review on the subject was carried out. Regarding the conclusions of the theoretical framework and the qualitative research, the multi-criteria decision-making method was applied to assess the best alternative for Public Policy to be pursued by the Public Administration in the management of the broadcasting sector, with a view to its future development.
 Findings: Based on the data obtained through qualitative research, the first result was the consensus among the consulted experts about the need to establish a new Public Policy for the broadcasting sector. Another result of the research is that this new Policy should primarily emerge through the revocation of the current regulations. In addition, another result highlights the necessity for the Public Policy to finally integrate the broadcasting sector into the public management model envisioned in the theory of a Regulatory State. Furthermore, the work also yields results regarding the potential of this Public Policy to promote the implementation of efficient, specialized, and streamlined public management with flexible administration and regulations adapted to the needs of rapid technological development.
 Research limitations: The analyses were conducted in accordance with the theoretical framework and applicable methodology. Qualitative research has inherent limitations due to the restricted number of experts interviewed for the semi-structured questionnaire. Additionally, the material from the theoretical framework and the multi-criteria decision-making methods have limitations in terms of interpretation and application in this work, given the small number of interviews conducted for the purpose of this research. These limitations should be taken into consideration when interpreting the findings and drawing conclusions from the study. Despite these constraints, the research provides valuable insights into the current state of the broadcasting sector and the challenges associated with existing legislation.
 Practical implications: The challenges, both administrative and sector-specific, posed by the current Public Policy for broadcasting (CBT) in this sector have been progressively debated in the sector, legal, and academic fields. However, when it comes to the future of this regulation and its impacts on public administration, the existing material is scarce and superficial. Therefore, this work contributes to advancing this topic and aims to provide greater clarity on the tasks to be undertaken by the public agents responsible for the broadcasting sector. It underscores the importance of modernizing the legal framework to ensure a sustainable future for the development of the broadcasting sector in Brazil.
 Social implications: Taking into account the importance of the broadcasting sector in providing free access to information, entertainment, and services to the Brazilian population, it is immediately clear how crucial it is to understand this dynamic and complex sector. It is essential to consider legislative and regulatory measures for its maintenance in light of the technological and business modernization occurring in the communications sector in Brazil. A new Public Policy, as indicated in the results of this work, focused on modernizing broadcasting and public administration activities, contributes to the sustainability of the social benefits of broadcasting in the face of the current challenges in the field of communications in Brazil and around the world.
 Originality: This work sheds light on the opportunity to modernize the Public Policy in the broadcasting sector. Its uniqueness lies in the compilation, within a single document, of the motivations identified in various academic studies, in the qualitative research conducted through interviews with broadcasting experts from a multi-sectoral perspective, and in the application of a multi-criteria decision-making method to determine the preferred form of updating Public Policy based on the input from the consulted experts.
