Resumo

This paper examines the technical and legal complexities related to the phenomenon of concurrent delays in construction projects, with a particular focus on private projects carried out in Brazil. To this end, the study begins with an overview of fundamental concepts of project planning and control, followed by an analysis of schedule assessment methodologies and the typical effects outlined in the international technical guidelines issued by AACE and SCL. From a legal perspective, the discussion addresses issues concerning the causal link and contractual civil liability in scenarios involving multiple concurrent causes attributable to both the responsible party and the injured party, with particular emphasis on the practical application of Article 945 of the Brazilian Civil Code. Building on these foundational concepts, the study assesses the feasibility of harmonizing legal dogmatics with the practical effects recommended by the aforementioned international technical standards, identifying the circumstances under which technical and legal approaches may be coherently combined to provide an appropriate legal response to the challenges posed by concurrent delay.
