Resumo

This essay compares the theories of justice that founded the set up of a universal health care supply model with the particular way in which the public health sector provides care for the population in Brazil. The main argument states that none of the criteria for postulated justice is reached in practical terms. In fact, there is no way to think about justice without considering the restrictions imposed by the shortage of economic resources. Within this context, the feasibility of the universal and free public health care model to produce health services according to quality and technology required by nowadays medicine is questioned. Therefore, two options appear. The first one is more comfortable, namely to carry on with the current model, which is a fallacy regarding universality. The other option is to reassess the public and free health care model, creating thereby criteria for access, consumer service priority and co-participation.
