Análise econômica da saúde suplementarjudicialização e aplicação da reserva do possível

Resumo

The discussions surrounding the judicialization of health, scarcity of resources, and the application of the principle of human dignity seem to have no end. The present work addresses such themes, without intending, however, to exhaust the subject, but rather to bring reflections on the actual behavior of the judiciary when faced with the principle of human dignity and the scarcity of resources in demands involving the Unified Health System and in demands involving supplementary health. Considering that the analysis comprises health systems with different financing models, the concepts of economic theory will be used in the analysis of the cases, with the aim of verifying the incentives generated in the respective decisions, as well as whether there is a differentiation in the weight attached to the principle of human dignity for the users of the SUS and for the beneficiaries of health plans.
