Análise das origens e das críticas ao protagonismo do STF no contexto de polarização

Resumo

This article examines how political polarization has impacted the actions of the Supreme Federal Court (STF), highlighting the Court’s prominent role amid Brazil’s contemporary institutional, political, and historical dynamics. The study discusses, drawing on specialized literature and recent cases, the factors that have contributed to activism and judicialization of politics and policies at the STF, especially following the changes brought about by the 1988 Constitution. The text does not aim to judge the correctness of the Supreme Court’s decisions, but rather to provide a critical and well-founded assessment of its role in Brazilian democracy, considering the context of political polarization, the strengthening of Congress, and the institutional crisis that has emerged in recent years. Finally, the article addresses the contemporary challenges faced by the Court, including the scenario shaped by the Covid-19 pandemic, and seeks to foster deeper reflection on the limits and potential of the STF in protecting democracy and fundamental rights.
