Resumo

The Federal Constitution of 1988 ensures everyone the right of access to health, including pharmaceuticals, when necessary, and that this right will be guaranteed by the State, directly or indirectly. Moreover, an increasing phenomenon of public policy legalization, including drugs, starting point of the analysis in this article, demonstrating the existence of latent conflicts between the public authorities and apparent between society, or part, and the State. In order to solve such conflicts, thus maintaining the minimum balance required for social interaction and social order, Law (the legal science) seeks mechanisms for the composition of the parties, executed in practice, as a rule, by the Judiciary. It is in this context that we find of this article object of study, since the involvement of the judiciary in social conflict resolution may be exaggerated or appropriate, which are explained by the theories of judicial activism and self-restraint.
