Análise das decisões dos Tribunais Superiores sobre normas editadas pelas agências reguladoras

Resumo

This paper aims to promote under empirical bases an analysis of judicial review of the decisions produced by high courts such as Federal Supreme Court (Supremo Tribunal Federal) and the Superior Court of Justice (Superior Tribunal de Justiça) on the regulatory agencies’s rulemaking. First, this paper discusses the regulatory agencies’s origin and its history in the Brazilian legal system and its rulemaking function. Second, this paper addresses the regulatory acts’s reviews. Finally, this paper examines the decisions in which high courts analysis technical standards created by the regulatory agencies setting their understanding on the regulatory acts’s judicial review
