Resumo

This book compiles articles written by alumni of the course Comparing Regulatory Governance in Brazil and the United States, taught by Professors E. Donald Elliott and Patrícia Sampaio in 2025 at FGV Law School in Rio de Janeiro, Brazil. The central theme revolves around the comparison of regulatory governance issues in the U.S. and Brazil. The articles highlight various relevant aspects of the similarities and differences between the Brazilian and U.S. models of the Administrative State. Topics include the separation of powers and the characteristics of Brazilian regulatory agencies in light of the U.S. model, administrative procedure, and judicial review. Readers will find in this volume valuable reflections on these topics, as well as current references to judicial precedents from both countries that have sought to address them.
