Indicadores de transparência no Programa Nacional de Transparência Públicaestudo de caso da transparência pública ativa dos municípios do Amazonas

Resumo

This dissertation aims to analyze the transparency indicators of the National Public Transparency Program (PNTP) based on a case study of the active public transparency of municipalities in Amazonas. The need for this research lies in the role played by transparency portals as tools for social control and legitimation of public management. The PNTP aims to evaluate the performance of official websites. The research problem is to investigate whether the methodology employed by the PNTP in evaluating public transparency portals adopts indicators of visibility and inferability. The hypothesis guiding the investigation is that the PNTP results are limited to investigating the dimension of visibility, disregarding aspects related to inferability, which would lead to false transparency. The theoretical framework addresses the concept of transparency, highlighting its polysemy and historical evolution, as well as the classification between active and passive transparency. To this end, it uses works developed by Carolyn Ball, Klein and Freire, Michener and Bersch, among others. This work emphasizes the centrality of electronic portals in the implementation of active transparency and presents the visibility (completeness and accessibility) and inferability (disaggregation, verifiability, and simplification) indicators proposed by Gregory Michener and Katherine Bersch. It highlights that the mere availability of data does not guarantee full transparency and may generate distortions if not accompanied by the necessary informational quality. Regarding the methodology, the research adopts an empirical approach, combining qualitative and quantitative elements. Data from the Public Transparency Radar were used, focusing on the 2023 fiscal year, when the updated ATRICON guidelines came into effect. The analysis was limited to the electronic portals of the municipalities and city councils of the State of Amazonas. Regarding the analysis of the PNTP methodology, a comparison was made with the methodology developed by the FGV Public Transparency Program, one of whose authors is Gregory Michener. The results revealed that, out of a total of 124 planned portals (62 city halls and 62 municipal councils), only 48 were effectively evaluated, corresponding to 38.71%. The average municipal transparency index in Amazonas was 42.56%, with 46.03% for city halls and 36.22% for councils. These numbers highlight the low adherence to the program and the deficit of active transparency in the State. It is concluded, rejecting the hypothesis, that the PNTP (National Transparency Program) represents a relevant advance in the evaluation of transparency policy and in strengthening social control, since its methodology aims to investigate whether the information present in the transparency portals meets the indicators of visibility and inferability. This dissertation falls within the research line of Regulatory Governance, Institutions and Justice, as it aims to diagnose problems related to the performance of public transparency, a relevant theme for the new administrative State, with a constitutional vocation and subject to the control of institutions adhering to the Court of Accounts system. Thus, this work contributes to the debate in the field of Regulatory Law, reinforcing the importance of institutional interaction between oversight bodies and public managers, and the need for the evolution of evaluation mechanisms so that active transparency fulfills its democratic and regulatory role.
