Resumo

This study aims to examine the procedural position of the Brazilian Trademark Office (BTO) in annulment actions involving industrial property rights, a subject of persistent controversy in procedural law and industrial property law. To this end, it presents introductory considerations on intellectual property within the Brazilian Legal System, including its legal nature, normative foundations, socio-economic function and the attributive system of rights. The study then analyzes the institutional structure of the BTO, its statutory powers, and its practical role in judicial nullity actions. Subsequently, it addresses the relevant procedural aspects, with emphasis on the concepts of parties, joinder of parties, and the form of third parties’ intervention, such as assistance and amicus curiae. Furthermore, the work analyzes the principal doctrine positions and the existing cases law. Finally, it examines the current understanding of the Superior Court of Justice, particularly the classification of the BTO under the theory of dynamic joinder (litisconsórcio dinâmico), which allows for so-called “interpolar migrantion” (migração interpolar) by the co-litigant.
