Resumo
Purpose: The study analyzes the challenges and implications of the judicialization of social security benefits in the management of the INSS, focusing on the impacts on budget planning and people management and proposes alternatives to mitigate its effects. Methodology: The research adopts a qualitative approach, consisting of two stages. The first stage involves the collection of secondary data through surveys in panels of the National Council of Justice (CNJ) and the National Treasury, in addition to semi-structured interviews with INSS employees, including heads of the Benefits Analysis Center (Ceab), employees of Social Security Agencies for the Service of Legal Demands (APSDJ) and professionals working temporarily at the Ceab for the Service of Legal Demands (Ceab/DJ), reflecting different positions and experiences in the service of legal demands. The second stage consists of data analysis, using categorization and axial coding to identify patterns and recurring themes. Findings: Judicialization is driven by poor quality in administrative analysis, lack of civil servants and regulatory diversity. This negatively affects budget planning, increasing payments of court orders, Small Value Requests (RPV), fines and interest. In people management, judicialization diverts civil servants to legal proceedings, generating work overload. To mitigate these effects, initiatives such as out-of-court settlements and the review and standardization of internal regulations are proposed. Research limitations: Limitations of the study include the convenience sampling of respondents and the lack of complete data on the number of employees available to Ceab/DJs. In addition, data on court orders and RPVs from October to December 2024 were not available, limiting the depth of the analysis. Practical implications: The study is original because it combines empirical analysis of interviews and official data with an integrated focus on the organizational effects of judicialization, especially in the budgetary and human resources dimensions. This approach is little explored in the national literature, standing out for the depth of the triangulation of sources. Social implications: The research contributes to the improvement of public services by highlighting the negative effects of judicialization on institutional efficiency and proposing viable paths to dejudicialization. By suggesting improvements in administrative and budgetary management, the study promotes the construction of a more agile and accessible social security system. Originality: The study is original because it combines empirical analysis of interviews and official data with an integrated focus on the organizational effects of judicialization, especially in the budgetary and human resources dimensions
