A intervenção do TCU na execução da política nacional de banda larga pela Anatel

Resumo

Within the context of a new regulatory framework for the provision of telecommunications services in the Brazilian market and definition of guidelines for the allocation of resources in the expansion of broadband infrastructure, the paper discusses the intervention of the Federal Court of Accounts (TCU) in the National Telecommunications Agency’s (Anatel) discretion for implementing the national telecommunications policy. For this purpose, a research was made to select and systematize the cases of inspection of the Anatel’s acts by the Court of Accounts, from a historical perspective, but also in relation to the compliance of the parameters determined by TCU to intervene in the regulatory game itself, particularly with respect to the control over projects for the expansion of services executed in accordance with public policy standards determined by the Executive Power.
