A interpretação dos elementos normativos do tipo objetivo dos crimes econômicos

Resumo

The research’s main objective is to revisit the category of the normative/legal elements of the criminal offense. Our goal is to elaborate on the concept proposed by Engisch in order to allows a proper differentiation between the normative elements and the remaining objective categories of the offense that also require a normative interpretation. Our analysis is oriented by the boundaries set-forth by language itself, through which we postulate that the criminal offense is a manifestation of a linguistic command and, therefore, subject to the same limitations that language itself is faced with. This preliminary conclusion shall lead us to conclude that the content of the normative element will not depend on a valuation carried out by the interpreter, but rather will represent a specific use of the language, that must be observed during the interpretation of the criminal offense. Regarding the case of the corporate criminal offenses, the observation of the uses of language corresponds to the delimitation of the prohibition and its adequacy to the norm that originates the criminal offense. We conclude by demonstrating that the main problems attributed to the use of normative elements are, in truth, pseudo-problems, arising from an exceedingly broad concept.
