Resumo

This paper examines the effectiveness of the right to gender equality for women in employment in Brazil, based on the articulation between legislation, case law, and empirical evidence. It starts from the recognition that, despite the existence of a robust normative framework for the protection of gender equality, structural inequalities persist that limit women’s access to, retention in, and professional advancement within the labor market. The objective is to identify the causes of this gap between formal equality and substantive equality and to assess the extent to which law has contributed to addressing it. A qualitative and interdisciplinary methodology is adopted, based on a literature review, normative and jurisprudential analysis, and the examination of national and international empirical data. The findings indicate that gender inequality in employment is structural, being associated with the sexual division of labor, the undervaluation of care work, occupational segregation, and institutional barriers, and that it is further aggravated by intersectional markers, such as race and class. It is concluded that, despite the existence of formal equality, the law shows limited effectiveness in the face of social structures that reproduce gender inequalities. As a contribution, the study proposes an analytical framework to guide public policies and corporate practices based on affirmative action.
