A aplicação do artigo 24 da LINDB e a revisão da validade das deliberações administrativas do Estado de São Paulo

Resumo

The purpose of this study is to assess the juridical practice of the State of Sao Paulo on the administrative review of administrative acts and contracts, to explain the general guidelines of the juridical regime of administrative deliberations enacted by the Lei nº 13.655, de 25 de abril de 2018, and to propose the formulation of a decree and a resolution that improves the administrative procedures of the Public Administration of the State of Sao Paulo. The proposal is based on the assessment that the new rules lay down a new dynamic between the administrative, the control and the judicial spheres which values the production of general orientations and which demands the implementation of a system of precedent accessible to the citizens and to the public authorities.
