Resumo
Purpose: The Study aims to present a proposal to modernize the legal framework for products, companies and establishments subject to the action of the National Health Surveillance System, in light of Laws n°s. 5.991/1973 and 6.360/1976 and the current theoretical framework of the Economic Complex- Health Industrial, to promote and protect the health of the population, promoting the country's development in action integrated with the SUS. Methodology: The methodological strategy involved exploratory, descriptive, qualitative and documentary research on the legislative scenario of control of products subject to the health surveillance regime and the creation of Anvisa and, on the other hand, on the Health Economic-Industrial Complex and the interface with the State Regulatory Power, with the aim of delving deeper into the topic, collecting and selecting information, to support the review study of Laws n°s. 5.991/1973 and 6.360/1976. Laurence Bardin's content analysis method was chosen, which consists of several analysis techniques, which seek to achieve systematic results that collaborate with the production of inferences. Findings: The new legislative proposal brings a modern vision of health regulation as an inducer of development, and not as a health barrier, it improves the focus of action for effective Health Risk Management, favoring the migration from the Pre-Market Model to the Post-Market, and seeks to integrate health regulation with the social and environmental dimensions of health, the economic and, therefore, geopolitical dimensions. Research Limitations: The study was limited to content analysis based on documents, books, articles, laws and decrees that deal with the topic directly or indirectly, and no interviews were carried out with authorities from the executive branch, the productive sector and specialists in the area, for This is why the formulation of legislative proposals tends to be a product that involves different interests and positions that can generate confrontations and a climate that is not favorable to collective construction, as already experienced by the author in other moments similar to this that paralyzed the formulation of proposals, which is why which is why the study, at this moment, was limited only to the author's analysis, contribution and inferences, given the broad base of content presented on the topic. Practical Implications: The work can be used to initiate the formulation of new public policy within the scope of the Legislative Branch, as well as the Executive Branch, with potential impact for Anvisa and the sectors regulated by it, which could have modern health legislation aimed at promoting health protecting the health of the population and also to foster the development, competitiveness, sustainability and innovation of the productive sector. Social Implications: Society will be able to participate in the formulation of a new legal framework for health surveillance, with great potential to generate public value, improving the formulation and development of various public policies, as well as their results for the productive sector and the subsystems that interact. with the Health Economic-Industrial Complex, seeking to ensure universal, equitable and comprehensive access to health. Originality: The study was developed based on current legislation, using the theory of the Health Economic-Industrial Complex to improve the performance of the State Regulatory Power in the health area.
