Teoria da transcendência dos motivos determinantes no direito brasileiroanálise constitucional

Resumo

The objective of this academic paper is to analyze, from the point of view of Constitutional Law, the Transcendence Theory of Determining Motives. In the context of approximation with the common law, aspects of the Theory of Precedents will be highlighted, especially the idea of ratio decidendi. In addition, the jurisprudence of the Federal Supreme Court will be disrupted in order to understand the moments of acceptance, indecision and, what is being experienced today, non-adherence to the transcendence of the determining motives by the Court. Of the highlighted cases, the arguments used by the Supreme Court will be studied. Finally, the paper will deal with controversial arguments that involve the Constitutional Complaint and the current valorization of precedents by the New Code of Civil Procedure.
