Soluções consensuais no TCUuma análise dos casos envolvendo setores regulados

Resumo

The theme of administrative consensuality has gained increasing prominence in recent years, being intrinsically linked to the conception of the state's function, particularly regarding the form and intensity of state intervention in the lives of' citizens. This study aims to analyze the role of the Federal Court of Accounts (Tribunal de Contas da União - TCU) as a new mediating entity in the consensual resolution of disputes between private individuals and the Public Administration in regulated sectors, particularly following the establishment of the SecexConsenso unit. The research was conducted through a theoretical review on the subject, as well as a quantitative and qualitative analysis of the proceedings handled by the aforementioned body from December 2022 to April 2025. By analyzing specific cases involving regulated sectors, the study seeks to assess whether the TCU can be considered an appropriate forum for consensual dispute resolution within the Brazilian legal system. in light of the institutional boundaries that define its role within the Brazilian legal framework. The empirical findings suggest that, although still in the process of consolidation. the TU's engagement in this domain shows promise in contributing to the construction of solutions. Nevertheless, points of tension remain between its function as an external oversight body and the role proposed by SecexConsenso.
