Saneamento básico e participação da iniciativa privadamão ou contramão? Uma análise do Novo Marco do Saneamento Básico no Brasil à luz de casos internacionais em que houve desestatização e, posterior, reestatização do serviço público

Resumo

The New Legal Framework for Basic Sanitation, represented by the changes introduced by Law No. 14,026, of 2020, opened space for greater participation by the private sector in the sector. The criticism of the new legislation, that drew attention, was that Brazil is
 going in the opposite direction to several countries in the world. From this, the present work intends to provide elements for this discussion, analyzing qualitatively how it
 started and gave the relationship with the private company and later re-statation in the cities of Hamilton, Canada; Buenos Aires, Argentina; and La Paz and El Alto, Bolivia.
 The main problems were related to the following points: contracting without bidding and public competition; regulatory and inspection difficulties; contractual design; noncompliance with contractual targets; and poor relationship with public opinion. Having identified the problems, an attempt was made to see whether the New Basic Sanitation Legal Framework establishes mechanisms that make it possible to work around these problems or whether Brazil seems to be following the path of failure in the relationship between basic sanitation and the private sector.
