Resumo

The research provides a national overview of the regionalization of water and sewage services in Brazil, through the mapping and analysis of the three existing models in the country: the State Sanitation Companies, promoted in the 1970s by the National Sanitation Plan; intermunicipal consortia, established in 2007; and the new formats introduced by Law nº 14.026, the New Basic Sanitation Law, in 2020. The analysis focuses on the relationships between the federative entities involved in these arrangements. The study presents the implementation context of each model, along with their central characteristics and an overview of their current scope. In addition to this national panorama, the research also conducts an indepth analysis of two case studies, in the states of Amapá and Rondônia, to examine the implementation process of regionalization that occurred after the 2020 law. The analytical approach adopted by this study is that of institutional arrangements for the implementation of public policies, which enabled the analysis of the relationships among federative instances, the interactions between bureaucracy and political systems, as well as the monitoring and social participation channels involved in the process. The research is based on the literature on federalism and public policies and the new federative dynamics in Brazil following the 1988 Constitution. The survey indicates that the State Sanitation Companies maintain a strong presence in most states, particularly in water services. On the other hand, the presence of consortia shows significant variation between states, with greater strength in Santa Catarina, Sergipe, Bahia, and Rio Grande do Sul, but with no records in five statesin the Northern region. The research also suggests that the creation of regional blocks after the New Basic Sanitation Law is advanced from a legal point of view, but many of these regional blocks still lack an operational governance structure. The research indicates that the sanitation regionalization policies still face difficulties in promoting coordination and cooperation among federative entities, i.e., in ensuring an articulation that includes an effective participation of all federation levels in regional arrangements.
