Resumo

Basic sanitation underwent profound changes with the enactment of Law 14,026 of 2020, aimed at universalizing access to basic sanitation services for the population. Among the innovations, the incentive for regionalization, under the responsibility of the states, stands out as a guideline. This work focused on one form of regionalization: the creation of microregions, with an emphasis on one of its dimensions, the microregional basic sanitation authority. Since the law came into effect, 29 micro-regions have been created, adding to the previously existing ones, totaling 44, distributed across 19 states. Only two states have not created microregional authorities. The main objective of this study was to identify alerts and recommendations to be observed in the institutionalization of the ongoing microregional authorities in the country, and also to point out how the legal framework underpins this regionalization model. The research investigated the microregional phenomenon from a constitutional perspective and in light of the basic sanitation legal framework, as well as analyzing precedents of the Supreme Federal Court on the regionalization of public functions and services. Additionally, the study mapped the state complementary laws that implemented the regionalization of basic sanitation, presenting an overview of the microregions and microregional authorities. From these approaches, the points of attention to be observed were consolidated, as well as recommendations to be considered in the institutionalization process of the microregional authority.
