Quem faz lobby pelo lobbyo debate a respeito da regulamentação da atividade no Brasil

Resumo

The regulation of lobbying is a topic debated in democracies around the world. In Brazil, this issue has been discussed for more than forty years without the adoption of a specific regulatory framework. Accordingly, this research aims to analyze how the regulation of lobbying is reflected in the agenda of decision-makers in Brazil, in order to identify the possible reasons why there is still no law regulating this activity in the country. The methodology employed includes a literature review, qualitative research, and data analysis. National and international works addressing the concept of lobbying, international cases of regulation, and the Brazilian trajectory on the subject were reviewed. The qualitative research was divided into two stages: in the first, data and information regarding Bill No. 2914/2022—the legislative proposal at the most advanced stage of deliberation in the National Congress concerning the regulation of lobbying— were identified and analyzed; in the second, interviews were conducted with relevant actors involved in the debate on the issue. The analysis of the data obtained allows us to identify that the stigma surrounding lobbying translates into a barrier to social participation and broad parliamentary engagement in the debates. As a result, discussions are sporadic and led by a small number of actors, especially professionals in the lobbying field, who, given the stigma attached to the profession, have their legitimacy to lead the debate questioned. Consequently, the arena of debates on lobbying in Brazil has taken the form of a restricted cycle of discussions, predominantly led by professionals in the field, which fails to achieve sufficient popular and institutional relevance to be transformed into law.
